- DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES;

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL CUMULATIVE LIABILITY OF ROUND TABLE PIZZA TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO YOUR USE OF THE WEBSITE OR PURCHASE OF PRODUCTS THROUGH THE WEBSITE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

You agree to defend, indemnify, and hold harmless Round Table Pizza, and its subsidiaries, affiliates, officers, agents, co-branders, partners, and employees, from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including but not limited to attorney's fees) arising from:

Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located within the United States, and you hereby irrevocably consent to the personal jurisdiction and venue therein. You waive any objection that you may now or hereafter have to the laying of venue of any such proceeding, and you waive any claim that such proceeding has been brought in an inconvenient forum.
14. Dispute Resolution
14.1 Informal Resolution
Before initiating any formal dispute resolution process, you agree to first contact us at [email protected] and provide a written description of the dispute, the relief sought, and your contact information. We will attempt to resolve the dispute informally within thirty (30) calendar days of receiving your written notice. If the dispute is not resolved within this period, either party may proceed to formal dispute resolution as described below.
14.2 Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Except for claims seeking emergency injunctive or equitable relief, any dispute, controversy, or claim arising out of or relating to these Terms, the Website, or any products or services provided by us — including any question regarding the existence, validity, or termination of these Terms — shall be finally resolved by binding arbitration administered by a nationally recognized arbitration organization such as the American Arbitration Association (AAA) under its Consumer Arbitration Rules, or such other arbitration rules as the parties may agree upon. Judgment upon the award rendered by the arbitrator may be entered in any court of competent jurisdiction.
The arbitration shall be conducted in English. The arbitrator shall apply applicable substantive law consistent with the Federal Arbitration Act (9 U.S.C. § 1 et seq.) and applicable statutes of limitations. The arbitrator shall have the authority to award any remedy that would be available in a court of law. The arbitrator's decision shall be final and binding on both parties.
14.3 Class Action Waiver
YOU AND ROUND TABLE PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, CLASS ARBITRATION, PRIVATE ATTORNEY GENERAL ACTION, OR OTHER REPRESENTATIVE PROCEEDING. Further, unless both you and we agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
14.4 Small Claims Court
Notwithstanding the foregoing, either party may bring an individual action in a small claims court of competent jurisdiction for disputes or claims that fall within the jurisdictional limits of such court.
15. Term and Termination
These Terms of Service remain in full force and effect while you use the Website or maintain an account with us. We reserve the right, in our sole discretion, to:
- Suspend or terminate your access to the Website and/or your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms;

In the event of a Force Majeure Event, we will make reasonable efforts to resume performance as soon as practicable.
